Jonathan Lovitz, a gay New Yorker, was excused from jury duty earlier this week. The reason for his dismissal is getting quite a bit of attention.
Here's what he told the judge: Since I can't get married or adopt a child in the state of New York, I can't possibly be an impartial judge of a citizen when I am considered a second class one in the eyes of this justice system."
The judge agreed. Lovitz appeared on MSNBC on Wednesday, where he discussed the jury duty incident, and was also given a nice plug for his upcoming LOGO reality show, Set-Up Squad.
However, according to James Withers at 365Gay.com, Lovitz was totally False, (Good Thing the Judge didn't catch on) the adoption point is wrong. Gay and lesbian New Yorkers are legally allowed to make homes for children. Here is the Human Rights Campaign cheat sheet on Empire State adoption laws. If you are going to take a stand for rights, best to know which ones you have and don’t.
As for the second class citizen claim, going to respectfully disagree. Until he says differently, I’m certain the following never happened to Mr. Rosa Parks (too catty?): when there was an election, he was denied participation due to a poll tax. If he takes public transportation, he must sit in the “gays only” section of the bus and/or subway. Stores refuse him services. Police authorities routinely require him to produce identification papers.
